Even if ISL Entitlement (ISLE) were to be adopted by the Court, this outlier drawn from a phrase in the Constitution would still be subject to state courts to the extent that interpretation of state statutes and state constitution provisions adopted by a popular vote are involved.

If such provisions are at issue, they reflect the expressed will of a superior legislature. A sitting legislature can pass laws to attempt to implement laws enacted by a popular vote, but that legislature cannot be the sole judge of whether that implementation is a rational and good faith effort to reflect the will of voters acting as a superior legislature.
